Purpose of the Policy

This Privacy Policy (the “Policy”) sets out the principles and practices by which Couvre-Planchers Solathèque (“Solathèque” or “we”) collects, uses, discloses, retains, and protects personal information entrusted to us in the course of our business activities, in compliance with the Act Respecting the Protection of Personal Information in the Private Sector (CQLR, c. P-39.1) and the obligations introduced by Law 25.

Definition of Personal Information

Personal information refers to any information that relates to an identifiable individual, whether directly or indirectly. Examples include a person’s name, home address, telephone number, email address, date of birth, financial or banking information, academic or professional history, as well as photographs, audio or video recordings.

Information concerning a legal entity, such as its business name or address, is not considered personal information. However, information about its directors, officers, or employees, as natural persons, is subject to protection under the Law.

Collection of Personal Information

Personal information may be collected in connection with employee recruitment, client service delivery, or any other voluntary interaction with Solathèque, including by email, telephone, website forms, or social media platforms.

Consent is obtained as follows:

  • In writing, when required for recruitment or service agreements;
  • Implicitly, when an individual voluntarily provides personal information to Solathèque through a chosen communication channel.

For minors under the age of 14, consent must be obtained from a parent or legal guardian.

Use of Personal Information

Personal information is used solely for the purposes identified at the time of collection, including:

  • managing client relationships and delivering services;
  • recruiting and hiring employees;
  • billing and financial transactions;
  • communicating with clients and business partners;
  • complying with legal and regulatory obligations.

Personal information will not be used for any other purpose without the individual’s prior consent, unless otherwise permitted or required by law.

Disclosure to Third Parties

Solathèque may disclose personal information to third parties strictly for the following purposes:

  • service providers (data hosting, IT support, payment processing, marketing, analytics, etc.), bound by confidentiality obligations;
  • professional partners and network members required to perform services;
  • insurers, regulatory authorities, tax authorities, securities regulators, or credit agencies;
  • law enforcement or investigative bodies, where required or authorized by law;
  • in the context of a corporate reorganization, merger, acquisition, or transfer of assets.

Under no circumstances does Solathèque sell or trade personal information for commercial purposes.

Retention and Destruction

Personal information is retained only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law.

Upon expiry of the retention period, information is securely destroyed or irreversibly anonymized, in accordance with recognized standards.

Security Measures

Solathèque implements administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including:

  • access controls, firewalls, antivirus protection, and regular updates;
  • strong password protocols and multi-factor authentication;
  • internal confidentiality policies applicable to employees and contractors.

Despite these measures, no technological system can guarantee absolute security, and Solathèque cannot warrant immunity from all risks of unauthorized access or interception.

Privacy Incidents

Any privacy incident involving personal information (unauthorized access, use, disclosure, loss, or alteration) will be recorded in an internal register.

Where the incident poses a serious risk of harm, Solathèque will notify the Commission d’accès à l’information du Québec (CAI) and any affected individual, in accordance with the Law.

Cookies

Our website uses cookies to collect anonymous usage data, such as pages visited and language preferences. Cookies do not enable us to identify individuals.

Individual Rights

In accordance with the Law, any individual whose personal information is held by Solathèque has the following rights, upon written request:

  • Access: to know whether we hold personal information about them and to obtain a copy in an intelligible format;
  • Correction: to have incomplete, inaccurate, or outdated information rectified;
  • Withdrawal of Consent: to withdraw or modify consent to the use or disclosure of personal information;
  • De-indexing: to request that personal information no longer be disseminated or indexed where such dissemination contravenes the law or a court order;
  • Portability: to obtain their computerized personal information in a structured, commonly used technological format, for transfer to a third party.

Solathèque will respond to all requests within a maximum of 30 days, subject to exceptions provided by law.
